Here is a general overview of how accident settlements typically unfold:

  1. Medical Treatment and Documentation:

  2. Investigation:

  6. Possible Litigation and Trial:
    Some cases can be settled before a lawsuit is filed. However, it has been our experience that most cases require a lawsuit for a fair resolution for our clients. If negotiations stall or the insurance company refuses to offer a fair settlement before or after a lawsuit is filed, the case may ultimately need to go to trial. It is actually common for cases to be settled even during trial, when the insurance company and defendants see that you and your attorneys are prepared, and willing to go to trial, and seeing how the evidence unfolds in front of a jury.
  7. Bottom Line: The bottom line is your attorney should attempt to settle your case – only if it is fair and justly compensates you for your harms and losses in your particular case. While most cases do settle, your attorney (and you) should be willing to take your case to trial if you are not treated fairly.
